OLD LYME ZONING COMMISSION
MINUTES OF PUBLIC HEARING
Monday, December 11, 2006
The Old Lyme Zoning Commission held a Public Hearing on Monday, December 11, 2006 at 7:30 p.m. in the Auditorium of Memorial Town Hall. Members present were Ted Kiritsis (Chairman), Jane Marsh (Secretary), Jane Cable, John Johnson, Howard Tooker (Alternate) and Steve Ames (Alternate). Also present was Ann Brown, Zoning Enforcement Officer.
1. Special Exception Application to erect a wall, 123 Boston Post Road, Michel Gosselin, applicant.
Chairman Kiritsis noted that this item was opened at the November meeting and continued to the December meeting. He noted that the legal ads and list of exhibits have been read for the record. Ms. Brown noted that the applicant is not present. She indicated that she did speak to Mr. Gosselin after the November meeting and he indicated that he forgot about the meeting
A motion was made by John Johnson and seconded by Jane Cable to defer the opening of this item until the applicant arrives.
Mr. Gosselin arrived at this time (7:35 p.m.).
Mr. Gosselin stated that the project is halfway complete. He noted that he was not aware that he needed to come before the Commission when he began construction of the wall and noted that he made application as soon as he became aware. Ms. Brown stated that the applicant is requesting permission to construct a wall up to 6 feet tall in the front setback area. She noted that the walls are indicated on the plot plan. Mr. Gosselin explained that he needs the wall to be 6’ for privacy. He indicated that when he comes out his front door, cars stopped at the stop sign on Sill Lane are looking directly at him. Ms. Brown noted that approval from the Zoning Commission is only required for that section of the wall that is between the green line on the site plan and the Boston Post Road;
that section of the wall that is in the front setback area.
Mr. Gosselin stated that the wall would also provide him safety from vehicles. He explained that in 1998 a car went into his neighbor’s living room. Mr. Gosselin stated that two years ago a car slid into his yard in the winter. He noted that the wall will also provide a screen from the noise of the Boston Post Road.
Ms. Brown stated that the applicant made an application to the Wetlands Commission because all of the work is within 100 feet of the regulated area. She noted that Mr. Gosselin has received his approval from the Wetlands Commission for the wall construction.
Mr. Gosselin stated that the wall will not obstruct his line of sight when exiting his property.
Mr. Tooker stated that Mr. Gosselin has been working very hard on his property for four or five years.
No one present spoke in favor or against this application. Hearing no further comments, Chairman Kiritsis asked for a motion to close the public hearing.
A motion was made by John Johnson, seconded by Jane Marsh and voted unanimously to close the Public Hearing for the Special Exception Application to erect a wall, 123 Boston Post Road, Michel Gosselin, applicant.
2. Petition to amend the Old Lyme Zoning Regulations, Proposed new Section 7.4.3.1, Lot Adjacent to a Limited Access Highway, Gary Yuknat, applicant.
Ms. Marsh read the legal notice and list of exhibits for the record. Chairman Kiritsis noted that the Commission members received copies of the referral responses in their packets.
Ms. Brown stated that at the last meeting the Commission received a letter from Attorney Branse making suggestions to modify the Regulation. She noted that Ms. Bartlett sent the modifications to Mr. Yuknat and contacted him several times to have him authorize the modifications so that his application could be modified. Ms. Brown noted that Mr. Yuknat never responded and a modified regulation was not given to the Town Clerk. She noted that Mr. Yuknat is also not present this evening.
A motion was made by Jane Cable, seconded by John Johnson and voted unanimously to continue the Public Hearing for the Petition to Amend the Old Lyme Zoning Regulations, Proposed new Section 7.4.3.1, Lot Adjacent to a Limited Access Highway, Gary Yuknat, applicant, to the January 8, 2007 Regular Meeting.
3. Petition to amend the Old Lyme Zoning Regulations, Sections 32.6.9, 32.6.10, 36.2.8, 36.10.2 and 36.14, Open Space, Old Lyme Zoning Commission, applicant. (Hearing to be opened; no testimony will be heard until January 8, 2007).
Chairman Kiritsis opened the hearing and explained that testimony will not be taken until the January 8, 2007 Regular Meeting when Attorney Branse can be present to answer questions and otherwise participate in the Public Hearing.
A motion was made by Jane Cable, seconded by John Johnson and voted unanimously to continue the Public Hearing for the Petition to amend the Old Lyme Zoning Regulations, Sections 32.6.9, 32.6.10, 36.2.8, 36.10.2 and 36.14, Open Space, Old Lyme Zoning Commission, applicant, to the January 8, 2007 Regular Meeting.
The Public Hearing adjourned at 7:51 p.m.
